Interpretation
In the terms and conditions hereunder unless the context otherwise requires:
- “Company” means Haeven Travel Services Ltd.
- “Collection Period” means the period for the collection of the Package to be communicated by the Company to the Package Holder.
- “Package” means a Wristband allowing access to a combination of events, amenities and/or costume selection provided by Spirit Mas inclusive of bodywear, shorts, and all other accompanying items and accessories in the Registered Section for which the Package Holder has paid the Package Price. The contents of the Package may vary depending on the selection of the Registered Section made by The Package Holder.
- “Package Price” means the price of the Package for the Company wristband as well as if the client has purchased a costume in a Registered Section.
- “Deposit” means a 50% down payment to be paid by the Package Holder to the Company towards the Package Price.
- “Distribution Centre” means the location from where the Package is to be collected during the Collection Period, to be communicated by the Company to the Package Holder.
- “Package Holder” means the person who has registered for the Package with the Company.
- “Package Holder’s Agent” means any person who is collecting the Package from the Distribution Centre on the Package Holder’s behalf.
- “Registered Section” means the section in the Mas Band for which the Package Holder has registered.
- “Wristband” means the wristband included with the Package that permits the Package Holder access to the Company and its events and amenities during the Carnival Season.
Terms & Conditions
A - Payment
- The Package Holder must pay The Deposit to the Company by January 31, 2026.
- Upon full payment of the Deposit to the Company by January 31, 2026, the Package Holder shall be registered with the Company for the Package of the selected events and/or costumes for the 2026 Carnival Festival.
- The balance of the Package Price must be paid in full by Package Holder or The Package Holder’s Agent to the Company prior to the commencement of the Collection Period, and the Company shall not accept payments at the Distribution Centre during the Collection Period.
- The Package remains the property of the Company until the Package Price is paid in full and the Package is collected.
B - Alterations
- Once the Package Holder is registered in a Registered Section the Company reserves the right to decline any requests from the Package Holder to return, exchange, or vary the measurements or size of the Package.
- The Company reserves the absolute right to refuse the exchange/swap of events within the Package if the request is less than 45 days prior to the Collection Period.
- The Package Holder may add events to their Package at any time subject to availability, however the Package Holder may not drop events less than 45 days prior to the Collection Period.
- The Package holder may request for alterations to be done for the amenities provided by the Company in the following manner:
- Car Rentals: Requests for changes of vehicles can be made and facilitated within 48 hours of booking subject to availability however, no changes can be facilitated for bookings made 7 days prior to the Collection Period.
- Glam: Requests for changes can be made and facilitated no less than 7 days prior to the Collection Period. Facilitation of changes is subject to availability.
- All request for alterations to the Package must be written via email to the Company by the Package Holder
- The Company reserves the right to utilize its sole discretion for the allowance of alteration requests.
C - Package Collection
- The Package is to be collected by the Package Holder or the Package Holder’s Agent at the Distribution Centre during the Collection Period.
- To mitigate against the risk of fraud and/or unauthorized collection of the Package, the person collecting the Package (be it the Package Holder or the Package Holder’s Agent) must present to the Company at the Distribution Centre at least one (1) form of government-issued identification and agree to have their photograph taken by the Company.
D - Resale
- The Company shall not facilitate any resale of The Package at any time.
E - Cancelation Policy
- All cancelation requests for events must be submitted via email to the Company and is considered valid only when acknowledged by the Company.
- The Deposit paid by the Package Holder to the Company is final and remains non-refundable at all times and under any circumstances.
- The Package Holder shall automatically forfeit the Deposit paid to the Company in the instance where the Package Holder wishes to cancel the Package.
- In the instance a cancellation request is made 45 days prior to the Collection Period, and the Package Holder has paid the entire Package Price, the Company shall refund the Package Holder 50% of the Package Price for all amenities excluding accommodation and events.
- In the instance a cancellation request is made 60 days prior to the Collection Period, and the Package Holder has paid the entire Package Price, the Company shall refund the Package Holder 50% of the Package Price for all amenities/events/accommodation.
- In the event of cancellation due to circumstances beyond the control of the Company (including but not limited to natural disasters, acts of God, government restrictions or pandemics), the Company reserves the right to:
- Postpone or reschedule the collection of The Package.
- Issue a credit or partial refund, at the Company’s discretion.
- Retain non-refundable fees, depending on supplier obligations.
- Failure to collect the package during the designated Collection Period without prior written communication will be considered a no-show. NO refunds, credits, or exchanges shall be issued by the Company in such cases.
F - Limited Liability
- To the fullest extent permitted under the laws of the Republic of Trinidad and Tobago, the Company, including its directors, employees, agents, shall not be held liable for any loss, injury, damage, expense, delay, or inconvenience, whether direct or indirect, arising from or in connection with the Company’s partners and in relation to:
- The booking, purchase, or participation of events facilitated by the Company;
- The acts, errors, omissions, or default of any third-party service provider, including but not limited to hotels, transport operators, or event organizers;
- Changes to itineraries, delays, cancellations, or disruptions caused by weather conditions, natural disasters, government regulations or advisories, health emergencies, public disturbances, or any other force majeure events beyond the Company’s control;
- Failure by the client to comply with immigration, customs, health, or entry requirements for Trinidad and Tobago or any other destination associated with the Package.
- The Company acts solely as an intermediary between the Package Holder and independent third-party suppliers and therefore shall not be held liable for any breach, negligence, or default on the part of such third parties.
- The Company’s total liability, if any, whether arising in contract, negligence, or otherwise, shall be limited strictly to the total amount actually paid by the Package Holder to the Company for the specific Package in question.
